Terms and Conditions

Welcome to skribbled^TM ("we," "us," or "our"). These Terms and Conditions (“Terms”) govern your access to and use of our mobile, web, and software applications, including all services, features, content, and functionalities offered through our platforms (the “Service”).

By using the Service, you agree to be bound by these Terms. If you do not agree, do not access or use the Service.

1. Eligibility

You must be at least 18 years old or have parental or guardian consent to use the Service. Children under 13 are not permitted without verifiable parental consent under COPPA.

2. Description of the Service

skribbled^TM is an AI-powered platform for generating personalized, illustrated children's stories. Using advanced AI, you can create, save, and share stories for personal use.

3. AI-Generated Content and Limitations

No Human Review: Content is automatically generated and not reviewed by humans.
Accuracy & Suitability: We do not guarantee error-free, unbiased, or universally appropriate content.
User Responsibility: You are responsible for reviewing all AI-generated content before sharing, selling, or otherwise distributing.

4. User Content and Prompt Responsibility

By entering prompts, inputs, or content, and otherwise using the Service:

You confirm you own the rights or have permission to use the content.
You agree not to submit anything illegal, harmful, inappropriate, or infringing.
You grant us a non-exclusive, royalty-free license to use all prompts, inputs, content, and generated stories.

5. Ownership and Licensing of Generated Content

Personal and Commerical License: You may use, download, and share all of your generated stories for personal or commercial use.
Marketplace License: Outlined in the Marketplace and Seller Terms ("Marketplace Terms").
Platform Ownership: skribbled^TM retains ownership of all software, models, code, infrastructure and service elements.

6. Intellectual Property

All software, models, code, branding, infrastructure, and service elements belong to skribbled^TM or its licensors. Unauthorized use is prohibited.

7. Payment and Subscriptions

Credit, Bundle and Subscription pricing is disclosed during checkout.
Payments are non-refundable unless required by law.
Free trials and promotions, when offered, are time-limited and restricted.

8. Marketplace and Seller Terms

As a registered user of skribbled^TM, you may access the marketplace feature ("Marketplace") that allows you to publish and sell AI-generated children’s stories on our platform. The following terms apply to all users who act as sellers on the platform.

8.1 Eligibility to Sell

You must have a verified account and be at least 18 years old (or the age of majority in your jurisdiction) to sell on the Marketplace. We reserve the right to approve, suspend, or revoke your ability to sell at any time and for any reason.

8.2 Ownership and Licensing of Content for Sale

All content offered for sale on our platform must be generated through our platform using our built-in tools.
You may not upload or sell third-party stories that were not created using our platform.
You may not resell or redistribute stories created by other users.
All listings must comply with our community guidelines and content policies.
Listing does not change our non-exclusive, royalty-free license to use all prompts, inputs, content, and generated stories.

8.3 Fees and Revenue Sharing

We charge a transaction fee of $1.00 USD or 20% of the purchase price (whichever is greater) per story sold.

Example: For a $3.00 story, our fee is $1.00.
Example: For a $10.00 story, our fee is $2.00 (20%).
Additional platform, currency, or processing fees, including thrid-party fees, may apply.
We reserve the right to modify fees and revenue sharing at any time and for any reason.

8.4 Payment and Payouts

Payouts are issued regularly (e.g., monthly or bi-weekly) for accounts in good standing.
You must provide accurate payment, tax, and other documentation as needed.
We are not liable for delays due to incomplete or incorrect seller info, third-party processing issues, or for any other reason.

8.5 Refunds and Disputes

Refunds may be issued for valid issues (e.g., file errors, policy violations).
Your seller earnings may be reversed if a refund is processed.
We may investigate abuse, withhold payouts, or suspend sellers during disputes.

8.6 Seller Conduct and Content Responsibility

Do not list harmful, misleading, plagiarized, or unlawful stories.
Do not engage in fraudulent activity or artificially inflate sales.
You are fully responsible for the quality and accuracy of your listings.
Listings may be removed for violations or repeated complaints.

8.7 AI-Generated Nature of Content

Buyers and sellers acknowledge that stories sold on the Marketplace are generated using AI. These may contain:

Errors, biases, or inconsistent tone and imagry.
Varying levels of educational or literary value.

You must review and verify your story’s appropriateness before listing. See Section 3 for additional information.

8.8 Termination or Removal

We may remove listings, suspend seller access, or terminate accounts at any time and for any reason, including due to violations, abuse, or inactivity.
We reserve the right to update Marketplace policies or fee structures at any time.

9. Prohibited Uses

Generating harmful, illegal, or inappropriate content.
Harming or exploiting minors.
Disrupting, scraping, or reverse-engineering the platform.
Selling generated content in a manner that violates the "Marketplace Terms".

10. Availability and Service Changes

We may modify or discontinue parts or all of the Service without notice. We are not responsible for outages, data loss, or other damages that may result from discontinuing the Service.

11. Privacy and Data

All prompts, inputs, content, and outputs may be used to improve our services.

12. Disclaimers

The Service is provided “as is” without warranties. We do not guarantee that:

Content is suitable for all purposes or audiences.
Service will be available at all times or error-free.
AI-generated stories or content are accurate, consistent, or appropriate.

13. Limitation of Liability

To the extent allowed by law, we are not liable for:

Indirect or consequential damages.
Loss of data, revenue, or profits.
Claims arising from the use of AI-generated stories or content.

14. Indemnification

You agree to indemnify skribbled^TM from any claims related to your use of the Service or violation of these Terms.

15. Termination

We may terminate or suspend your access at any time and for any reason, including for violating these Terms. You may stop using the Service at any time.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Michigan. Disputes shall be resolved through binding arbitration under AAA rules, unless otherwise required by law.

17. Account Deletion

You may delete your account and associated data at any time by visiting your account settings page.

18. Trademarks

All trademarks, service marks, trade names, logos, and other brand identifiers used in connection with the Service, including but not limited to skribbled^TM, our logo, and any branded features or designs (collectively, the “Trademarks”) are the property of skribbled^TM or its licensors.

You may not use, copy, imitate, or incorporate the Trademarks in whole or in part without prior written consent from skribbled^TM. Unauthorized use of the Trademarks is strictly prohibited and may violate trademark laws, unfair competition laws, and other applicable statutes.

Nothing in these Terms grants you any license or right to use the Trademarks.

19. Changes to Terms

We may update these Terms. Continued use of the Service means you accept the updated terms.
